Three men — two in Victoria and one in South Australia, have been accused of intentionally spreading HIV. Another man is under police investigation in Victoria. In both states the health departments were aware of risky behave, but didn’t call in the police. The reason? Reportedly there were concerns about privacy of rights of the individuals involved. Deliberately spreading HIV is very much a crime unique to modern times. But it’s clear that defining exactly what that crime involves — and when police should get involved - is leaving a potential gap in protecting the community. There are also serious issues involved in whether people, such as the man in South Australia, can be detained for what they might do, rather than what they have already done. In Victoria police accidentally discovered that the health department had concerns about the activities of 1. HIV patients when they were wrongly handed the files during an investigation into just one man’s sexual activities. The police were reportedly stunned to find out the department had not alerted them to the other cases. The HIV- positive man police were investigating, Michael Neal, had allegedly tried to infect 1. He has since been committed for trial on 1. HIV. It emerged during the committal hearing that health department advisers recommended the man be detained to curb his activities, but the advice was “lost†for four months. After getting their hands on the other files last year, police have charged a second man with recklessly causing serious injury by not declaring his HIV status to a female sexual partner. Another man is still under investigation. In South Australia a HIV- positive man has been detained two years after that state’s health department became aware he was a potential risk. He was only arrested and taken to a secure mental health facility after the state health minister became aware of the situation and called in police. The minister has not ruled out the possibility that there are other HIV- positive men in the community intentionally spreading the disease. In NSW a man is serving a jail sentence for deliberately infecting two women with AIDS. In that case the offender, an immigrant from Africa, was repeatedly counselled about the risk he posed if he had unprotected sex. He went ahead anyway and later was reluctant to provide authorities with the identities of his sexual partners, so they could be tested. It’s clear from the Victorian and South Australian cases that the point at which such case stop being a health issue and start becoming a criminal issue is at best undefined. In both, crucial delays occurred before police were brought in, leaving the community at risk. Balancing the legal rights of HIV victims with the rights of the community is clearly difficult.
